What are the OHS obligations on a Quebec construction site?

Occupational health and safety (OHS) on Quebec construction sites is governed by the OHSA (Occupational Health and Safety Act) and the OHS Regulation. The CNESST enforces compliance.

Employer obligations (s. 51 OHSA):

  • Provide CSA-compliant personal protective equipment (PPE)
  • Develop a prevention program
  • Train workers on hazards
  • Maintain a safe environment

Key technical rules (OHSR):

  • Falls: Guardrails required from 3 metres
  • Trenches: Shoring required beyond 1.2 m
  • Confined spaces: Work permit + atmosphere testing + attendant
  • Lockout: Mandatory procedure before work on energized equipment
  • WHMIS: Labelling + SDS + training for all hazardous products

Right of refusal: A worker may refuse dangerous work without reprisal. A CNESST inspector rules in case of disagreement.
